This how AJF Consultants is handling The Federal Do Not Call guidelines, which are scheduled to be enforced starting October 1st of 2003. Representatives have been in continuous contact with the Federal Trade Commission, the Federal Communications Commission, and the Direct Marketing Association in order to understand our and your responsibilities and liabilities once this law goes into effect. The intent of this information is to advise you of the new FTC/FCC Do Not Call list, and to let you know how we will be handling your counts and orders.

Consumer addresses and profiles purchased for mailing and research purposes are not covered by this law; it only affects telemarketing. Other exemptions include:

  • Business to Business marketing
  • Business to Consumer marketing where a financial transaction has taken place in the last 18 months, or a customer initiated inquiry in the last 3 months
  • Surveys
  • Non-profit Fundraising
  • Political Fundraising

Consumer counts received from AJF Consultants will reflect the number of pre-scrubbed phones available. Pre-scrubbed represents the number of phones available after the Federal DNC list is suppressed. The counts can be adjusted for exemptions.

Each consumer order with phones output will require either a SAN# (Subscription Account Number) or a signed waiver form. The SAN# is up to 10 digits long followed by a hyphen followed by another 6 digits, and is assigned by the FTC/FCC once a license to scrub a phone file is obtained. Data for up to five area codes will be available for free. Beyond that, there is an annual fee of $25 per area code of data, with a maximum annual fee of $7,375 for the entire U.S. database. It is the end-user's responsibility to obtain the SAN# and provide it to AJF Consultants. Please refer to the FTC for registration. The process is available on https://telemarketing.donotcall.gov/. Please be aware that data purchased prior to September 22nd, 2003 will not be compliant with the new FTC/FCC Do Not Call rules. Such lists will require scrubbing for non-exempt end-users. Please contact your AJF Consultants representative for this service.

Should you be exempt from the new DNC laws, you will need to sign a waiver to allow AJF Consultants to provide unscrubbed phones. To request an exempt waiver form please e-mail or phone us for a copy.

State Do Not Call records will continue to be processed as they were before. Unless otherwise requested, these phones are automatically suppressed on every count and order.

We had wanted to keep this information short and simple, but sometimes these new laws do not allow it. I apologize if we have confused anyone, or left out any details that are pertinent to your business. If so, feel free to respond to us with your questions. The way the rules are set, it is the "end consumers" responsibility to follow the rules and regulations of the "Do Not Call Files".
